Evidences of Sunnah Prayers in Jumuah Salāh

Question: What is the evidence of the Sunnah prayers in Jumuah?

Answer:

With reference to your particular case, the four sunnats before and four, as well as two after the Jumuah Salāh, are established in many ahadith. Some of these are mentioned below:

حَدَّثَنَا ابْنُ أَبِي عُمَرَ، قَالَ: حَدَّثَنَا سُفْيَانُ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ: قَالَ رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: مَنْ كَانَ مِنْكُمْ مُصَلِّيًا بَعْدَ الجُمُعَةِ فَلْيُصَلِّ أَرْبَعًا.هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ. (سنن الترمذي،كتاب الجمعة، ٥٢٣)

Sayyidunā Abu Hurairah radhiyallahu anhu reports that the Allāh’s Messenger sallallahu alayhi wasallam said: “Whoever prays after jumuah should pray 4 rakaats.”

حَدَّثَنَا قُتَيْبَةُ، قَالَ: حَدَّثَنَا اللَّيْثُ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّهُ كَانَ إِذَا صَلَّى الجُمُعَةَ انْصَرَفَ فَصَلَّى سَجْدَتَيْنِ فِي بَيْتِهِ، ثُمَّ قَالَ: كَانَ رَسُولُ اللهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَصْنَعُ ذَلِكَ. هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ. (سنن الترمذي،كتاب الجمعة، ٥٢٢)

Sayyidunā Abdullah ibn Umar radhiyallahu anhu narrates that he would go and read 2 rakaats after jumuah in his home and then said that Allāh’s Messenger sallallahu alayhi wasallam used to do the same.

وحدثنا يحيى بن يحيى أخبرنا خالد بن عبد الله عن سهيل عن أبيه عن أبي هريرة قال قال رسول الله صلى الله عليه وسلم إذا صلى أحدكم الجمعة فليصل بعدها أربعا (مسلم،كتاب الجمعة، باب الصلاة الجمعة، ٨٨١)

Sayyidunā Abu Hurairah radhiyallahu anhu narrates that the Allāh’s Messenger sallallahu alayhi wasallam said, “Whenever any of you pray jumuah Salāh then he should pray 4 rakats after it.”

أخبرنا الثوري، عن عطاء بن السائب، عن أبي عبد الرحمن السلمي قال: (كان عبد الله يأمرنا أن نصلي قبل الجمعة أربعا وبعدها أربعا) رواه عبد الرزاق في “مصنفه “ كذا في “نصب الراية” (١: ٣١٨) (إعلاء السنن، كتاب الصلاة، النوافل والسنن، جلد ٧، ص٩، أدارة القرآن)

Abu Abdirrahman as sulami said that Abdullah ibn Umar radhiyallahu anhu would command us to read 4 rakaats prior to Jumuah and 4 thereafter.

Based on the Ahadeeth combined, one must perform both the 4 and 2 rakaats.

Medicine Containing Ethanol Alcohol

Question: Is it permissible to drink cough medicine containing ethanol alcohol? Is the ruling the same if found in other products like cosmetic products and so on?

Answer

The key issue to your query is the legal status of using ethanol alcohol. Ethanol (or Ethyl) is produced from the process of fermentation, which is the chemical breakdown of sugar by yeast. Its derivative sources are mostly fruits and vegetation products, commonly used for recreational purposes. Ethanol can be found in variety of sources such as medicinal applications, chemical solvents, anti-septic, household cleaning and cosmetic products and potentially in certain foods and drinks. It is the key ingredient for all alcohol beverages, giving all alcohols its intoxicating effect. Ethanol is an intoxicating agent and albeit it is present in certain food (such as vanilla extract) and drinks as an additive and medicine such as cough medicine relatively in small quantity, it still holds its intoxicating properties but minimal. Its purpose as a food additive is to enhance the flavour of food extracts whilst in medicine, it is there to preserve the product. When ethanol is denatured – adding substances such as gasoline after it is separated from water – it loses its intoxicating properties and no longer fit for consumption due to its toxic nature. It is this denatured ethanol that is used in fuel, antiseptic, solvents and cosmetic products.[1]

From the Islamic Shar’ee perspective, ethanol is not impure so long as it isn’t derived from grapes, dates and raisins. It is however intoxicating in nature (this is before it is denatured) and generally to consume anything intoxicating is prohibited due to the prophetic tradition, all intoxicating products are harām. On the basis of this, any food, drink, or medicine containing ethanol as an additive should be avoided, but if the percentage is miniscule amount that does not intoxicate then permissible. If it is known that source of ethanol is from grapes, dates or raisins then it is impure and hence, not permissible irrespective of the quantity. Consuming it for medicinal purpose would be allowed under the above conditions. Other than that, all non-consumable products such as antiseptic, solvents and cosmetic ones that contain denatured ethanol are permissible to use as they are not considered impure due to the chemical process and non-derivatives of grapes, dates and raisins.

Relocating elsewhere to Observe Divorce period due to Harassment

Question: Is it permissible for a divorcee to relocate elsewhere to observe her iddah if her family members will harass and antagonize her?

Answer

In reference to your query, the command for a divorced woman to observe her Iddah in the home in which she was residing with her husband is a Quranic command. Allāh Almighty states, “Do not drive them out of their homes and neither should they emerge themselves except if they come with clear shamelessness.”[1] She cannot relocate elsewhere to observe her waiting period of divorce unless she has a valid excuse. Such valid excuses include those that will cause her imminent physical or monetary harm, for instance, no financial support to cover her basic needs, fear of personal belongings being stolen, the roof of her house will collapse or no money to pay off the rent of the house for instance. Only in such cases can she now relocate elsewhere to observe her iddah.[2] In your particular case, therefore, you can relocate only if you are more than likely to suffer real physical or monetary harm through such harassment, otherwise, you must continue observing your waiting period in your husband’s accommodation until your iddah expires.

When is Yellow discharge Classed as Period Bleeding?

Question: If a woman sees yellow discharge very frequently then is that classed as menstruation?

In the name of Allāh, the Most Gracious, the Most Merciful

Answer:

With reference to yellow discharge there are a few different rulings.

The general ruling is that yellow discharge is classed as menstruation if it is seen within the days of menstruation. There are six colours of blood/discharge which are classed as period if seen within the days of menstruation. These are: red, black, yellow, green, light brown, dark brown.[1] If yellow is seen outside of the days of menstruation days then it won’t be classed as menses and she can continue praying her Salāh.

For illustration purposes let’s say a woman who does not frequently see yellow discharge and has a period habit of 7 days experiences. There are two scenarios:

2. If someone very frequently sees yellow discharge throughout the month outside of the normal haidh habit then her yellow discharge will not be classed as haidh.[2]

For illustration purpose, let’s say a woman who has a habit of seeing yellow discharge very frequently with a normal habit of 7 days sees the following;

In the above scenario, despite the woman seeing yellow discharge for 10 days from the 20^th -30^th after 15 days of purity, this yellow discharge will not be classed as period. Also, the yellow discharge she saw on the 8^th-9^th will also not be classed as period even though it is at the end of her period. This ruling is for that woman who sees yellow discharge excessively, otherwise if a woman rarely sees yellow discharge then the 8th and 9th of January will be classed as periods as its within 10 days and hence, changing her habit from 7 to 9 days.

So to summarize, seeing yellow discharge that is very frequent will be classed as period bleeding only if seen during the normal days of menstruation and not outside of her normal habit as illustrated above. If she rarely sees yellow discharge then it will be classed as periods provided if it occurs within ten days and not beyond that and not during the 15 days of her purity days otherwise it will be classed as Istihadhah bleeding.

A final note that yellow discharge that is not classed as periods is still impure and nullifies the wudhu. Hence, she must do istinjaa and renew her wudhu but if it is very frequent fulfilling the laws of ma’zoor, then simply renew the wudhu once for every fardh Salāh.

وفي الغياثية: الصحيح أن الصفرة حيض…و كان الشيخ ابو منصور الماتريدي رحمه الله مرة يقول في الصفرة: إذا رأتها ابرداء في زمان الحيض إنها حيض، و أما إذا رأتها في زمان الطهر و اتصل ذلك بزمان الحيض، فإنها لا تكون حيضا، ومرة يقول: إذا اعتادت المرأة أن تري أيام الطهر صفرة و أيام الحيض حمرة فحكم صفرتها يكون حكم الطهر حتي لو امتدت هي بها لم يحكم لها بالحيض في شيء في هذه الصفرة، و حكمها حكم الطهر علي قول أكثر المشايخ رحمهم الله

[وفي المعراج عن فخر الأئمة: لو أفتى مفت بشيء من هذه الأقوال في مواضع الضرورة طلبا للتيسير كان حسنا. اهـ وخصه بالضرورة؛ لأن هذه الألوان كلها حيض في أيامه لما في موطأ مالك ” كانت النساء يبعثن إلى عائشة بالدرجة فيها الكرسف فيه الصفرة من دم الحيض لتنظر إليه فتقول: لا تعجلن حتى ترين القصة البيضاء تريد بذلك الطهر من الحيض ” اهـ والدرجة: بضم الدال وفتح الجيم خرقة ونحوها تدخلها المرأة في فرجها لتعرف أزال الدم أم لا. والقصة بفتح القاف وتشديد الصاد المهملة الجصة؛ والمعنى أن تخرج الدرجة كأنها قصة لا يخالطها صفرة ولا تربية؛ وهو مجاز عن الانقطاع.

Women Teaching children to Pray Salāh in Jamat

Question: Can a woman lead minor girls in Jamat so to teach them how to pray Salāh until they are able to read independently?

Answer

Regarding your particular query, the Hanafi jurists have ruled that a woman leading other women in congregation is Makrooh Tahrimi (disliked). This is because that congregational Salāh is generally not prescribed for them because performing Salāh individually is preferred for them. Furthermore, women performing Salāh individually is more concealing in their respect.[1]

However, teaching minor girls Salāh is necessary so if possible, teach them Salāh alternative to the congregational method. If teaching them through congregational practice is more effective for them then the female Imām should stand in the middle of the row with the minor girls standing by her side. Once the girls become familiar with the practical mode of Salāh then they should now perform it individually. Performing in a congregation should not be a habitual practice.

Question: Is It permissible to perform Qadha Salāh After Fajr and Asr Salāh?

Answer:

With reference to your query, it is permissible to perform Qadha Salāh after Fajr until sunrise and after Asr until the colour of the sun changes to red. This takes place 5-10 minutes before the beginning time of Maghrib.[1]

Making Loud Dhikr After Fardh Salāh

Question: Certain people Recite Zikr – Lā ilā ha Illallah – loud after every Fardh Salāh quoting the Hadeeth of Sayyduna Abdullāh Ibn Abbas t that the companions would do this. How true is this and would they recite it aloud after every Fardh Salāh continuously or not?

Answer:

Thank you for your above question, with reference to your particular case, it is generally permissible to make dhikr after every Fardh Salāh. The Hadith quoted however of reciting dhikr loud during the time of the Messenger of Allāh sallallahu alayhi wasallam, then scholars of Hadith state that this is practised so to teach the dhikr only, not so it becomes a continuous practice. Moreover, scholars have preferred the method of doing dhikr quietly unless it is done to teach others to do dhikr. [1] It should not be prolonged whereby it causes a long delay between the Fardh and Sunnah prayers.[2]

قال ابن بطال : وفي ” العتبية ” عن مالك أن ذلك محدث . قال : وفي السياق إشعار بأن الصحابة لم يكونوا يرفعون أصواتهم بالذكر في الوقت الذي قال فيه ابن عباس ما قال . قلت : في التقييد بالصحابة نظر ، بل لم يكن حينئذ من الصحابة إلا القليل ، وقال النووي : حمل الشافعي هذا الحديث على أنهم جهروا به وقتا يسيرا لأجل تعليم صفة الذكر ، لا أنهم داوموا على الجهر به ، والمختار أن الإمام والمأموم يخفيان الذكر إلا إن احتيج إلى التعليم .

Non-Baligh Hafiz to Lead the Tarāweeh

Question: Is it permissible for a non-Baligh child who has memorised the Qur’ān to lead others in the Tarāweeh Salāh?

Answer:

With reference to your particular case, according to the Hanafi Madhab, a non-baligh child cannot lead adults in Tarāweeh Salāh because Salāh counts as a Nafil (optional) for a child and the Salāh of a child and an adult are completely different. Some fuqaha are of the opinion that a child’s Salāh does not count towards the obligatory Salāhs as he is commanded to pray only so he becomes habitual in performing Salāh, hence all his Salāh fall within the optional category, as opposed to a baligh person. A young child, therefore, cannot lead adults in Tarāweeh and if so, then they must repeat their Salāh.[1]

وَأَطْلَقَ فَسَادَ الِاقْتِدَاءِ بِالصَّبِيِّ فَشَمِلَ الْفَرْضَ وَالنَّفَلَ وَهُوَ الْمُخْتَارُ كَمَا فِي الْهِدَايَةِ وَهُوَ قَوْلُ الْعَامَّةِ كَمَا فِي الْمُحِيطِ، وَهُوَ ظَاهِرُ الرِّوَايَةِ كَمَا ذَكَرَهُ الْإِسْبِيجَابِيُّ وَغَيْرُهُ؛ لِأَنَّ نَفْلَ الْبَالِغِ مَضْمُونٌ حَتَّى يَجِبُ الْقَضَاءُ إذَا أَفْسَدَهُ وَنَفْلَ الصَّبِيِّ لَيْسَ بِمَضْمُونٍ حَتَّى لَا يَجِبُ الْقَضَاءُ عَلَيْهِ بِالْإِفْسَادِ فَيَكُونُ نَفْلُ الصَّبِيِّ دُونَ نَفْلِ الْبَالِغِ فَلَا يَجُوزُ أَنْ يَبْنِيَ الْقَوِيُّ عَلَى الضَّعِيفِ وَلَا يَرِدُ عَلَيْهِ الِاقْتِدَاءُ بِالظَّانِّ أَيْ بِمَنْ ظَنَّ أَنَّ عَلَيْهِ فَرْضًا، ثُمَّ تَبَيَّنَّ خِلَافُهُ فَإِنَّ الِاقْتِدَاءَ بِهِ صَحِيحٌ نَفْلًا مَعَ أَنَّ نَفْلَ الْمُقْتَدِي مَضْمُونٌ عَلَيْهِ بِالْإِفْسَادِ حَتَّى يَلْزَمُهُ الْقَضَاءُ وَنَفْلُ الْإِمَامِ لَيْسَ بِمَضْمُونٍ عَلَيْهِ حَتَّى لَا يَلْزَمُهُ الْقَضَاءُ؛ لِأَنَّهُ مُجْتَهِدٌ فِي وُجُوبِ قَضَائِهِ عَلَى الظَّانِّ فَإِنَّ زُفَرَ يَقُولُ بِوُجُوبِهِ فَاعْتُبِرَ الظَّنُّ الْعَارِضُ عَدَمًا فِي حَقِّ الْمُقْتَدِي بِخِلَافِ الصَّبِيِّ، وَمَشَايِخُ بَلْخٍ جَوَّزُوا اقْتِدَاءَ الْبَالِغِ بِالصَّبِيِّ فِي غَيْرِ الْفَرْضِ قِيَاسًا عَلَى الْمَظْنُونِ، وَقَدْ عَلِمْت جَوَابَهُ، وَفِي النِّهَايَةِ وَالِاخْتِلَافُ رَاجِعٌ إلَى أَنَّ صَلَاةَ الصَّبِيِّ هَلْ هِيَ صَلَاةٌ أَمْ لَا؟ قِيلَ لَيْسَتْ بِصَلَاةٍ وَإِنَّمَا يُؤْمَرُ بِهَا تَخَلُّقًا، وَلِهَذَا لَوْ صَلَّتْ الْمُرَاهِقَةُ بِغَيْرِ قِنَاعٍ فَإِنَّهُ يَجُوزُ وَقِيلَ هِيَ صَلَاةٌ، وَلِهَذَا لَوْ قَهْقَهَ الْمُرَاهِقُ فِي الصَّلَاةِ يُؤْمَرُ بِالْوُضُوءِ اهـ.

وَإِمَامَةُ الصَّبِيِّ الْمُرَاهِقِ لَصِبْيَانٍ مِثْلِهِ يَجُوزُ. كَذَا فِي الْخُلَاصَةِ وَعَلَى قَوْلِ أَئِمَّةِ بَلْخٍ يَصِحُّ الِاقْتِدَاءُ بِالصِّبْيَانِ فِي التَّرَاوِيحِ وَالسُّنَنِ الْمُطْلَقَةِ. كَذَا فِي فَتَاوَى قَاضِي خَانْ الْمُخْتَارُ أَنَّهُ لَا يَجُوزُ فِي الصَّلَوَاتِ كُلِّهَا. كَذَا فِي الْهِدَايَةِ وَهُوَ الْأَصَحُّ. هَكَذَا فِي الْمُحِيطِ وَهُوَ قَوْلُ الْعَامَّةِ وَهُوَ ظَاهِرُ الرِّوَايَةِ. هَكَذَا فِي الْبَحْرِ الرَّائِقِ

Implanting a Coil and Irregular Bleeding

السلام عليكم ورحمة الله وبركاته

Question: I had a coil implanted two years ago as advised by my doctor so to space out the year gaps between my children should I ever consider having another child. Now that I have removed the coil (with the intention of having another child) this has disrupted my bleeding pattern and as a result, become irregular. There are times where I continuously bleed beyond my normal days which was seven days. Do I consider myself impure until I stop bleeding or not? Please advise me in this regard?

In the name of Allāh, the Most Gracious, the Most Merciful

Answer:

Thank you for your above question. An irregular pattern of bleeding can complicate a woman’s menstrual cycle so, in such circumstances, it is always best to apply the general principles outlined by the Shari’ah so not to confuse the days of purity with menses. With reference to your particular case, if your bleeding continues for more than ten days then seven days will still remain as your original habit and the rest as istihadha. If your bleeding exceeds the seven days mark but stops on the tenth day or less then it implies that you now have a new habit (as maximum days of periods are ten days).

For illustration purpose, let’s assume that if your normal habit in November and December was seven days then (after removing the coil) in January you bled until the ninth day then nine days is now your new habit. But if in January you bled until the thirteenth day (from the seventh day) then seven days is your normal habit whilst the remaining six days istihadhah – days of purity.[1] The rule to remember is that the bleeding must stop within ten days (or on the tenth) for the change in the habit. If the bleeding exceeds the tenth-day mark beyond your normal habit then stick to your original habit.

As a recommendation, the coil in itself is permissible as it is a type of reversible contraception. But care must be taken that it should be used as a last option, considering that it involves exposure of the satr which is generally forbidden and that other alternative contraceptive methods are possible. However, if implanting it is necessary then a female doctor should be sought for this and if not possible then a male doctor as a last resort because exposure of satr (in times of necessity) to a female is lesser degree harm compared to a male.[2]

وَلَوْ رَأَتْ قَبْلَ أَيَّامِهَا مَا يَكُونُ حَيْضًا وَفِي أَيَّامِهَا مَا يَكُونُ حَيْضًا فَعَنْ أَبِي حَنِيفَةَ رِوَايَتَانِ وَكَذَا الْحُكْمُ فِي الْمُتَأَخِّرِ غَيْرَ أَنَّهَا إذَا رَأَتْ فِي أَيَّامِهَا مَا يَكُونُ حَيْضًا وَبَعْدَ أَيَّامِهَا مَا لَا يَكُونُ حَيْضًا يَكُونُ الْكُلُّ حَيْضًا رِوَايَةً وَاحِدَةً عَنْ أَبِي حَنِيفَةَ،

)وَأَمَّا) صَاحِبَةُ الْعَادَّةِ فِي الْحَيْض إذَا كَانَتْ عَادَتُهَا عَشْرَةً فَزَادَ الدَّمُ عَلَيْهَا فَالزِّيَادَةُ اسْتِحَاضَةٌ، وَإِنْ كَانَتْ عَادَتُهَا خَمْسَةً فَالزِّيَادَةُ عَلَيْهَا حَيْضٌ مَعَهَا إلَى تَمَامِ الْعَشَرَةِ لِمَا ذَكَرْنَا فِي الْمُبْتَدَأَةِ بِالْحَيْضِ، وَإِنْ جَاوَزَ الْعَشَرَةَ فَعَادَتُهَا حَيْضٌ، وَمَا زَادَ عَلَيْهَا اسْتِحَاضَةٌ لِقَوْلِ النَّبِيِّ – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – «الْمُسْتَحَاضَةُ تَدَعُ الصَّلَاةَ أَيَّامَ أَقْرَائِهَا» أَيْ: أَيَّامُ حَيْضِهَا، وَلِأَنَّ مَا رَأَتْ فِي أَيَّامِهَا حَيْضٌ بِيَقِينٍ، وَمَا زَادَ عَلَى الْعَشَرَةِ اسْتِحَاضَةٌ بِيَقِينٍ، وَمَا بَيْنَ ذَلِكَ مُتَرَدِّدٌ بَيْنَ أَنْ يُلْحَقَ بِمَا قَبْلَهُ فَيَكُونُ حَيْضًا، فَلَا تُصَلِّي، وَبَيْنَ أَنْ يُلْحَقَ بِمَا بَعْدَهُ فَيَكُونُ اسْتِحَاضَةً فَتُصَلِّي، فَلَا تَتْرُكُ الصَّلَاةَ بِالشَّكِّ، وَإِنْ لَمْ يَكُنْ لَهَا عَادَةٌ مَعْرُوفَةٌ بِأَنْ كَانَتْ تَرَى شَهْرًا سِتًّا، وَشَهْرًا سَبْعًا فَاسْتَمَرَّ بِهَا الدَّمُ فَإِنَّهَا تَأْخُذُ فِي حَقِّ الصَّلَاةِ، وَالصَّوْمِ، وَالرَّجْعَةِ بِالْأَقَلِّ، وَفِي حَقِّ انْقِضَاءِ الْعِدَّةِ، وَالْغَشَيَانِ بِالْأَكْثَرِ فَعَلَيْهَا إذَا رَأَتْ سِتَّةَ أَيَّامٍ فِي الِاسْتِمْرَارِ أَنْ تَغْتَسِلَ فِي الْيَوْمِ السَّابِعِ لِتَمَامِ السَّادِسِ، وَتُصَلِّيَ فِيهِ، وَتَصُومَ إنْ كَانَ دَخَلَ عَلَيْهَا شَهْرُ رَمَضَانَ لِأَنَّهُ يُحْتَمَلُ أَنْ يَكُونَ السَّابِعُ حَيْضًا……

وَلَوْ كَانَتْ عَادَتُهَا خَمْسَةً فَحَاضَتْ سِتَّةً، ثُمَّ حَاضَتْ حَيْضَةً أُخْرَى سَبْعَةً، ثُمَّ حَاضَتْ حَيْضَةً أُخْرَى سِتَّةً فَعَادَتُهَا سِتَّةٌ بِالْإِجْمَاعِ حَتَّى يُبْنَى الِاسْتِمْرَارُ عَلَيْهَا أَمَّا عِنْدَ أَبِي يُوسُفَ فَلِأَنَّ الْعَادَةَ تَنْتَقِلُ بِالْمَرَّةِ الْوَاحِدَةِ، وَإِنَّمَا يُبْنَى الِاسْتِمْرَارُ عَلَى الْمَرَّةِ الْأَخِيرَةِ، لِأَنَّ الْعَادَةَ انْتَقَلَتْ إلَيْهَا.

(وَشِرَائِهَا وَمُدَاوَاتِهَا يَنْظُرُ) الطَّبِيبُ (إلَى مَوْضِعِ مَرَضِهَا بِقَدْرِ الضَّرُورَةِ) إذْ الضَّرُورَاتُ تَتَقَدَّرُ بِقَدْرِهَا وَكَذَا نَظَرُ قَابِلَةٍ وَخَتَّانٍ وَيَنْبَغِي أَنْ يُعَلِّمَ امْرَأَةً تُدَاوِيهَا لِأَنَّ نَظَرَ الْجِنْسِ إلَى الْجِنْسِ أَخَفُّ.

(قَوْلُهُ وَيَنْبَغِي إلَخْ) كَذَا أَطْلَقَهُ فِي الْهِدَايَةِ وَالْخَانِيَّةِ. وَقَالَ فِي الْجَوْهَرَةِ: إذَا كَانَ الْمَرَضُ فِي سَائِرِ بَدَنِهَا غَيْرَ الْفَرْجِ يَجُوزُ النَّظَرُ إلَيْهِ عِنْدَ الدَّوَاءِ، لِأَنَّهُ مَوْضِعُ ضَرُورَةٍ، وَإِنْ كَانَ فِي مَوْضِعِ الْفَرْجِ، فَيَنْبَغِي أَنْ يُعَلِّمَ امْرَأَةً تُدَاوِيهَا فَإِنْ لَمْ تُوجَدْ وَخَافُوا عَلَيْهَا أَنْ تَهْلِكَ أَوْ يُصِيبَهَا وَجَعٌ لَا تَحْتَمِلُهُ يَسْتُرُوا مِنْهَا كُلَّ شَيْءٍ إلَّا مَوْضِعَ الْعِلَّةِ ثُمَّ يُدَاوِيهَا الرَّجُلُ وَيَغُضُّ بَصَرَهُ مَا اسْتَطَاعَ إلَّا عَنْ مَوْضِعِ الْجُرْحِ اهـ فَتَأَمَّلْ وَالظَّاهِرُ أَنَّ ” يَنْبَغِيَ ” هُنَا لِلْوُجُوبِ
