Question: I suffer from psoriasis which makes my skin intensely itchy and when scratching (itching can be unbearable) I sometimes I get small cuts that bleed. The bleeding sometimes doesn’t flow but stays in one place, or it looks pink with clear fluid (also not flowing), my question is in relation to wudhu in this state.

  1. I understand flowing blood from wounds break wudhu, however where its not flowing but wound is not dry – does clothing Touching the wet blood/clear fluid and therefore moving or absorbing it break the wudu? Eg if on my knees, i kneel and it absorbs into trousers?
  2. If there is some blood not flowing from the original place e.g. on my elbow , but water from wudhu washes it out and moves it, does this affect wudhu?
  3. As this is a lifelong condition that gets better or more severe throughout the year, is there any concessions due to illness for my wudhu?
  4. I understand some madhabs donโ€™t view bleeding from skin as impure and not breaking wudhu, so can I temporarily adopt this view when I have flare ups?

Answer:

Thank for your query. We appreciate the severity of the situation in dealing with psoriasis and keeping up with your spiritual responsibilities. We pray that Allah Almighty grants you a permanent recovery and improves your condition, Ameen. Concerning your query, when blood becomes visible on a wound, it does not automatically render the wudhu invalid until it flows. As you mentioned in your case that blood or clear fluid becomes visible but does not flow then it does not break the wudhu. If the blood or clear fluid is absorbed by the clothes then its quantity will be examined. If it is to the extent that it could have flowed by itself then wudhu shall be invalid, otherwise the wudhu remains intact if it is a small, tiny amount without the possibility of flowing, unless those tiny amounts appear on different parts of the clothes in a single time amount to the possibility of flowing, only then the wudhu breaks. [1] This will also be considered when the water enters the wounds during wudhu as in, whether the blood ends up flowing or not from its place. There is however a concession in such scenarios that if a person has cuts in his limbs and washing those affected limbs during wudhu is not possible due to pain and difficulty that you may perform masah over those affected limbs during a flare up and if masah is also not possible and all of the wudhu limbs are severely affected, then you may ย perform tayammum as a last resort. [2] Given the above concessions, there is no need in resorting to the opinions of ย different schools of thought.

What to Do If the Government Prevents You from Performing Umrah?

Question: I live in Jeddah. I made the intention for Umrah after performing the two Rakah Sunnah. There at the checkpoint I was stopped and government didnโ€™t let us do Umrah regardless of permit saying state has issued new orders post Maghrib. Now we came back to Jeddah trimmed our hair and removed our Ihram in order to abandon the Ihram. I have lived the whole day normally and even cut nails after coming out of Ihram. Do we have to give Dam as we were forced to not perform Umrah as it was state rule and we had no other choice? We canโ€™t give Dam in Makkah as they are not allowing except Hajjis and this means we canโ€™t visit Makkah before 50 days now and perform our Umrah we cannot remain in the state of Ihram for that long. So please clarify the ruling.

Answer:ย  As a general ruling, if a Muhrim (someone in the state of Ihram) is prevented from performing Umrah due to the governmentโ€™s legislation, then the Muhrim must send an animal (e.g. sheep or goat) to be slaughtered and fix a time for its slaughter within the vicinity of the Haram. This is known as Dam Ihsar. They remain in the state of Ihram until they receive the news that the animal has been slaughtered after which they become Halal. Without the animal being slaughtered, they remain in the state of Ihram even after returning home and incur a penalty each time they commit any of the prohibited acts of Ihram such as cutting the hair, clipping the nails, applying fragrance etc. Trimming or shaving the head when coming out of Ihram is mustahab and not necessary as the slaughter would suffice.[1]

In your particular case, as described above you should have sent the animal to be slaughtered but you mentioned that this was not possible and therefore incentivised by cutting your hair in order to abandon your Ihram. Due to abandoning your Ihram, you must give a separate Dam (which is different from Dam Ihsar) as a penalty for coming out of Ihram before completing the acts of Umrah and must do Qadha of the Umrah later.[2]

Answer: Concerning your query, Qurbani is compulsory upon every adult Muslim, male or female, who owns surplus wealth equal to the value of the lowest nisab of Zakat on either the 10th or 11th or 12th of Dhul Hijjah. The lowest nisab of Zakat is the silver nisab,[1] which is 612.36 grams. The nisab value calculated today (14/06/24) is ยฃ453.15. This slightly fluctuate on a daily basis. In your case, the gold that you own reaches the lowest nisab and therefore, Qurbani will be wajib upon you despite not having any additional savings.[2]

Question: ย A person travelled this year to perform Umrah. After performing their umrah, if they go to the miqฤt but donโ€™t make the intention for umrah but for another reason and returns to haram without Ihrฤm, must they give dam?

Answer

In reference to the above question, if such an individual travels from Makkah to the miqฤt point or crosses it and thereafter intends to return to Makkah, then they must be in the state of Ihrฤm otherwise a penalty of dam would be required. This is due to them entering Makkah without performing the sacred rights of Hajj or Umrah[1]. The concession for returning without Ihrฤm applies to those residing in the hill (the vicinity between haram and miqฤt such as Jeddah or Tanโ€™eem). So, if an individual travelled to any area within the hill vicinity, then returning with Ihrฤm wonโ€™t be necessary.[2] The fact that the person in question had crossed the hill and reached to the miqฤt wonโ€™t be permitted to return without lhrฤm, otherwise a dam would be necessary.[3]

It is important to note that taxi drivers or those similar to them who frequently cross the boundaries (such as travelling between Makkah and Madinah) are exempted from the aforementioned ruling due to necessity.

Question:ย  Is Zakฤt Fardh on me since I’m in debt to family and friends. I borrowed for house improvements. I have almost 30k on my head. Is Zakฤt still Fardh on me?

In reference to your query, it depends on whether or not you have any remaining wealth after paying off your debt. As a general rule, if an individual Muslim after paying off his debt has sufficient wealth beyond their essentials equivalent to the nisฤb level after paying off personal debt then Zakฤt must be calculated on the remaining wealth. Zakฤt will not be required if the loan amount consumes the entire wealth and the remaining wealth is less than the nisฤb level.[1]

Another factor to consider is the short-term and long-term debt rule. If your debt is short-term as in the whole amount will be paid within a year then the above ruling applies. If the loan is long-term and exceeds a year in duration of payment, as in paid in small instalments for instance over a few years, then the ruling will be different in which case, only the amount paid in one year will be deducted from Zakฤt calculation and payable on the remaining amount if it reaches the nisฤb level. Otherwise, if the remaining wealth is less than the nisฤb level then Zakฤt wonโ€™t be applicable. [2]

ย Question: I have a question about preforming umrah. I understand in order to do tawฤf we have to be in the state of wudhu. I suffer from IBS and constantly pass wind sometimes every few minutes. Please can you advise me on what this means for while I try to preform umrah. Iโ€™m afraid that if Iโ€™m constantly passing wind will my umrah/tawฤf be accepted.?

Answer

It is important to first understand the conditions for a person to become mazoor (excused person) and to remain mazoor have different meanings. If due to the constant passing of wind you are unable to keep your wudhu with ease for one complete fardh Salฤh time nor able to pray Salฤh either then you will be classed as a Shari mazoor person. If after that, the passing of wind continues but not necessarily encompassing the entire time will not revoke your mazoor status so long as it continues even least once during the fardh Salฤh time.[1]

The ruling for a mazoor person is that their wudhu only needs to be renewed before every fardh Salฤh time. To illustrate this with an example, if the illness of constantly passing wind continued throughout Dhuhr time the first time of its occurrence, then they would be considered mazoor from that point on even if it happened merely once thereafter. This wudhu will remain intact (despite the illness) as of which you can perform as many worships as you wish until the end time of that Salฤh. You must then renew your wudhu when the next Salฤh time begins.

In reference to your query, as you said you pass wind every few minutes and not being able to retain your wudhu then based on the above explanation, you qualify as a mazoor. You may continue to perform tawฤf as your wudhu will remain intact until the Salฤh time ends. If you do not complete your tawฤf by then then you must renew your wudhu and then continue with your tawฤf.

Giving Zakฤt to my Son in-law who is Studying

ย Question: Can I give Zakฤt to my son in law who wants to study? I give my Zakฤt every year in Ramadhan and he will only start studying around June. Is it ok for me not to disclose it to him that it is Zakฤt money? He does work but earns a low salary which goes into his necessities and he does not have the Nisab amount.

Answer

In reference your query, the conditions for one to be eligible for Zakฤt is that they do not possess any additional savings or assets equal or above the Nisab threshold. Assets do not include basic necessities such as house, furniture, clothing etc. If a person earns less than the Nisab amount or is using all of his earnings for basic necessities, will be eligible for Zakฤt.[1] If your son in law fulfils these conditions then you may give your Zakฤt to him and doing so will be more rewarding.[2]

The next matter concerns delaying ones Zakฤt. One should refrain from delaying their payment of Zakฤt for more than one year as doing so without a valid excuse is sinful.[3] As your Zakฤt will only be delayed by a few months, there is no harm in doing so. You may also choose not to disclose it to him either and can give it in the name of a gift provided at the time of giving, you made the intention of Zakฤt in your heart.
