Question: I am writing to you from Azerbaijan. I am 41 years old. In my 20s, I promised to myself that I would spend 1/7th of my income for the sake of Allฤh. I thought that 1/7th share is more than 1/40th and includes Zakฤt, so I never gave Zakฤt then. One brother advised me that the 1/7th I set aside from my income is considered as sadaqah , and I also have to give Zakฤt. What is your thought on that? If I have to give Zakฤt in addition to 1/7th, should I also pay for the past years?

Answer

Concerning your query about setting aside money from your income for sadaqah assuming it included Zakฤt, it is important first to understand that the fardh (obligatory) amount for Zakฤt to be discharged is 2.5% (1/40th). Moreover, it is necessary to make the intention of Zakฤt at the time of separating the wealth.[1]

When setting aside some money for sadaqah, you must think back whether or not you recall making the intention of Zakฤt at the time and you must be certain about it too. If you did not make a separate intention, then your Zakฤt for the previous years will not be valid and must be paid again.[2] Contrarily, if at the time you did specify the intention of Zakฤt, then your Zakฤt of those years will be discharged provided you gave it to the rightful and eligible recipients and fulfilled all of the other necessary conditions of Zakฤt.

You must take notice of the above ruling for future reference to ensure your obligation of Zakฤt is discharged correctly.

Question: I have one tola gold which estimates around the value of ยฃ680. I have no additional cash savings except for this one tola gold only. Would Qurbani still be wajib on me?ย

Answer: Concerning your query, Qurbani is compulsory upon every adult Muslim, male or female, who owns surplus wealth equal to the value of the lowest nisab of Zakat on either the 10th or 11th or 12th of Dhul Hijjah. The lowest nisab of Zakat is the silver nisab,[1] which is 612.36 grams. The nisab value calculated today (14/06/24) is ยฃ453.15. This slightly fluctuate on a daily basis. In your case, the gold that you own reaches the lowest nisab and therefore, Qurbani will be wajib upon you despite not having any additional savings.[2]

Question:ย  Is Zakฤt Fardh on me since I’m in debt to family and friends. I borrowed for house improvements. I have almost 30k on my head. Is Zakฤt still Fardh on me?

In reference to your query, it depends on whether or not you have any remaining wealth after paying off your debt. As a general rule, if an individual Muslim after paying off his debt has sufficient wealth beyond their essentials equivalent to the nisฤb level after paying off personal debt then Zakฤt must be calculated on the remaining wealth. Zakฤt will not be required if the loan amount consumes the entire wealth and the remaining wealth is less than the nisฤb level.[1]

Another factor to consider is the short-term and long-term debt rule. If your debt is short-term as in the whole amount will be paid within a year then the above ruling applies. If the loan is long-term and exceeds a year in duration of payment, as in paid in small instalments for instance over a few years, then the ruling will be different in which case, only the amount paid in one year will be deducted from Zakฤt calculation and payable on the remaining amount if it reaches the nisฤb level. Otherwise, if the remaining wealth is less than the nisฤb level then Zakฤt wonโ€™t be applicable. [2]

Giving Zakฤt to my Son in-law who is Studying

ย Question: Can I give Zakฤt to my son in law who wants to study? I give my Zakฤt every year in Ramadhan and he will only start studying around June. Is it ok for me not to disclose it to him that it is Zakฤt money? He does work but earns a low salary which goes into his necessities and he does not have the Nisab amount.

Answer

In reference your query, the conditions for one to be eligible for Zakฤt is that they do not possess any additional savings or assets equal or above the Nisab threshold. Assets do not include basic necessities such as house, furniture, clothing etc. If a person earns less than the Nisab amount or is using all of his earnings for basic necessities, will be eligible for Zakฤt.[1] If your son in law fulfils these conditions then you may give your Zakฤt to him and doing so will be more rewarding.[2]

The next matter concerns delaying ones Zakฤt. One should refrain from delaying their payment of Zakฤt for more than one year as doing so without a valid excuse is sinful.[3] As your Zakฤt will only be delayed by a few months, there is no harm in doing so. You may also choose not to disclose it to him either and can give it in the name of a gift provided at the time of giving, you made the intention of Zakฤt in your heart.

How Should a Creditor Calculate Zakฤt on the Previous Years?

Question: I just wanted to ask that someone owes me money and agreed to pay me and they haven’t paid me for a few years. When I calculate Zakฤt on it, do I have to keep paying Zakฤt on the same money every year until they pay me back or just pay it all at once upon receiving the whole amount?

Answer

In reference to the above query, if you lent somebody money and you are certain that they will pay you then you must pay Zakฤt on the previous years since the time you loaned them your money.[1] You could calculate the previous yearโ€™s Zakฤt either after they return the money to you or pay yearly before they return the money to you.[2] Zakฤt will be calculated at 2.5% of the amount you lent so for instance, if you lent them ยฃ1000 then you would pay ยฃ25 Zakฤt but there is some details regarding this. If you decide to pay Zakฤt altogether of the previous years after receiving the full amount then the Zakฤt amount will be subtracted every year from the original loaned money. For instance, if the person decides to pay you after three years and thereafter you calculate Zakฤt on those three years then the first year you will pay ยฃ25 from ยฃ1000, the second year you will pay ยฃ24.37 from ยฃ975 and third year ยฃ23.76 from ยฃ950.63 and so forth. This is because each year Zakฤt is deemed as a valid debt which is deducted every year from the original amount.[3] If you however decide to pay Zakฤt every year before receiving the full amount then you pay ยฃ25 every year regardless because no debt was incurred each year.

Question: I currently have a debt of ยฃ20,000. I have ยฃ15,000 worth of gold in my possession which I do not intend to sell off to pay of my debt. Do I still need to pay Zakฤt on the gold or is it waivered due to the debt?

Answer

Concerning your query, firstly note that there is a contemporary view about debt that immediate debts known as short-term debts; i.e. those that need to be paid back within the next 12 months can be waivered from your Zakฤt calculation. As for long-term debts which do not need to be paid back within the next 12 months but after that, are not waivered and Zakฤt must be paid on them. This is evident by the principle of a person who has not yet paid the mahr to his wife, if he intends on paying it within the next 12 months then it can be waivered from his Zakฤt but if he intends do give it after 12 months then he must pay Zakฤt on it. In your case, if the debt is to be paid off in the next 12 months, then it can be deducted from your Zakฤt, but if there was an agreement of paying off your debt after 12 months then it will not be deducted from Zakฤt calculation.[1] Despite of you not intending to sell your gold to pay off the debt, Islamically, gold silver and cash all fall under the same category of ruling. In other words, even by possessing gold and also being in debt in cash that overwhelms the value of gold would legally affect the Zakฤt rulings on gold (or silver) and hence will be waivered if paid within 12 months that is.[2]

A Family Member Paying for My Zakat and for My Qurbani

Question: Traditionally, my father has paid for my Zakฤt and my grandad pays for my Qurbani. Once I started earning myself, I feared these wonโ€™t be accepted if done on my behalf, however both would like to continue as is. I currently:

  • transfer the zakat amount to my fatherโ€™s bank without his approval
  • pay for an additional Qurbani myself via an online charity (which I have heard is not permissible), as I donโ€™t know of any alternatives and my family wonโ€™t allow me to pay towards the one, they usually organise.

If you could you shed some light on this would be useful to know the rulings around this.

Answer

In reference to your query, as a general ruling to note that it is permissible for another person to pay Zakฤt on your behalf. In this case, if your father or grandfather wish to pay for your Zakฤt then it will be fulfilled with the condition that they notify you prior to paying it or you had prior awareness of them paying it on your behalf.[1] If they pay for it without your knowledge or you did not consent to it, then your Zakฤt will not be fulfilled.[2] It is not necessary for you to transfer additional Zakฤt money onto him without his knowledge if you knew that he has already paid for your Zakฤt.

With regards to Qurbani, a person who possesses the required Nisab during the Qurbani days must offer Qurbani whether themselves or someone performing it on their behalf. The obligation of Qurbani is fulfilled if members of your family pay for the sacrifice on your behalf, regardless if they pay for it from their own wealth or not. An additional Qurbani from yourself is therefore not required. It is always commendable to arrange your own Qurbani but not necessary for its validity. It should be noted that when Qurbani is wajib, then the same principle in Zakฤt i.e. consent is required unless they customarily perform Qurbani on your behalf whilst you being aware of it (in which case it will be fulfilled).[3]

Lastly, it is permissible for you to use an online charity to pay for your Qurbani as long as one has done sufficient research to ensure the reliability of the charity.

Question: My query is about 2 months after my Zakat due date my gold got stolen and I haven’t paid Zakat on it yet. Do I still need to pay Zakฤt on the gold or not? And does it depend on whether all of the gold was stolen or a portion of it was stolen?ย

Answer:

In reference to your query, as a general note Zakฤt must be paid immediately after owning the Nisab (minimum threshold) of all Zakatable assets that last for one lunar year. In your case where the gold was stolen and Zakat was not yet paid for this gold, then if all of the gold was stolen then Zakฤt will be waived from that person. In other words, Zakฤt is now pardoned. However, if some portion of the gold was stolen then Zakฤt must be calculated on the remainder potion. The amount of Zakฤt payable will now be deducted from the original calculation.[1]

Question: Can sadaqatul fitr be given to non-Muslims? For Instance, on Eid day can I give it to those homeless people sitting outside Tesco or Asda etc?

Answer

We thank you for this important query. Concerning the query itself, the classical Hanafi jurists have differed whether sadaqatul fitr or any other wajib charity such as kaffarah or sadaqah of personal vow can be given to a non-Muslim or not and to which type of non-Muslim. First understand that there are different categories of non-Muslims which the classical literatures discuss. Understanding this is essential as each category has their distinct rulings. The classical jurists divide non-Muslims into three categories as follows;

 

  1. Ahlu dhimma โ€“ Those non-Muslims residing in Muslims lands under the protection of an Islamic government.
  2. Harbi โ€“ A non-Muslim residing in in a non-Muslim state who are at war against Muslims.
  3. Mustaโ€™min โ€“ A non-Muslim temporary sojourning in a Muslim land under protection.

 

By consensus, sadaqatul fitr cannot be given to the second and third category (primarily due to non-existence of peace). Sadaqatul fitr can be given to the ahlu dhimmah according to both Imฤm Abลซ Haneefah rahimahullah and Imฤm Muhammad rahimahullah. Imฤm Abลซ Yลซsuf rahimahullah however disallows it. [1] He equates it to the ruling of Zakฤt as in, just as Zakฤt cannot be given to a non-Muslim by consensus, then wajib charity cannot be given to them also. Imฤm Muhammad rahimahullah despite the concession still prefers donating it to a Muslim. Imฤm Abลซ Haneefahโ€™s rahimahullah reason for allowing it is because the purpose of sadaqah is to fulfil peopleโ€™s needs which is rewarding to the donor similar to optional charity. This is fulfilled even by giving sadaqtul fitr to the ahlu dhimmah. Moreover, giving charity to such non-Muslims falls under the remit of kind treatment towards them which the Quran allows. Zakฤt eligibility however is exceptional to this case due to the Hadeeth of Sayyiduna Muโ€™adh radhiyallahu anhu which specifies Muslims to be the only legitimate recipients of it. The reason for the underlying differences becomes apparent that Imฤm Abลซ Yลซsuf rahimahullah equates sadaqtul fitr to Zakฤt as both are obligatory charities whilst Imฤm Abลซ Haneefah rahimahullah equates it to optional charity. Imฤm Muhammad rahimahullah on the other hand prefers the middle ground in that he permits it but prefers to prioritise Muslims.[2]

The question is which of the above categories do todayโ€™s non-Muslims fall under? Muslims residing alongside non-Muslims in western lands makes it difficult to categorise non-Muslims into any of the above three categories due to the change of the social dynamics. Clearly, they do not belong to the ahlu dhimmah category and neither harbi due to truce existing between Muslims and non-Muslim government. Mustamin is also not applicable as they refer to those harbies sojourning in Muslim lands. We must therefore refer to the principle alluded by Imฤm Abลซ Haneefah rahimahullah which suggests that Islฤm does not prohibit Muslims from kind treatment towards non-Muslims who do not jeopardise the faith, lives and property of Muslims. Giving charity also includes kind treatment towards them.

So to conclude, with the exception of Zakฤt any form of charity whether it is optional or wajib such as sadaqatul fitr can be given to present day non-Muslim beggars on the streets based on the above principle although prioritising Muslims would be better so to avoid the differences. ย

Question: If you have lent somebody money and have already been paying Zakฤt on it for several years but no longer have hope of ever receiving that money back, must you continue to pay Zakฤt on it or not?

In the name of Allฤh, the Most Gracious, the Most Merciful

Answer: Thank for your query. In relation to your query, a loan given out to someone which now leads you to believe that you will not receive that money ever again falls under the similar ruling as Mal-e-Dhimaar which means inaccessible wealth whereby a person has lost hope of receiving their wealth back or the borrower denies the debt and no evidence or claim can be made against them.[1] The ruling for such debts is that you are no longer required to pay Zakฤt on this wealth as it is out of your control.[2] After losing all hopes, if by chance the borrower ends up returning your money many years later and it fulfils all of the necessary conditions of Zakฤt, then Zakฤt would be necessary for that year only and not for the previous years.
