Question: I had a miscarriage on 26th June and was bleeding until 3rd July. I was then spotting until 19 July. I have now had spotting on 30th July, 31 July and 2nd August. Is this haydh or istihadha?

In reference to your query, first note the general principles. According to Hanafi school, the minimum bleeding period for haydh is 3 days and 3 nights (72 hours). The maximum is 10 days and 10 nights (240 hours). Any bleeding that occurs before the end of the minimum period and after the maximum period will be classified as istihadha (irregular bleeding).[1]
The ruling for a woman who exceeds the maximum period (10 days) of bleeding is that she will have to refer back to a previous habit of bleeding. This means she will look at the last cycle in which there was no irregular bleeding (described above) followed by a minimum period of purity (15 days). She will use the same number of days to determine her days of haydh and regard the remaining days of bleeding as istihadha. Anything that goes beyond the maximum and ends before the minimum cannot be used as her habit.[2]
Let’s illustrate the above with an example. Supposedly, a woman with an established habit blead for 13 days. She has exceeded the maximum period and so, she will look back at her previous valid habit. If her last valid habit was five days of bleeding, then she will count the first five of the 13 days as her haydh and the remaining days as istihadha. Her bleeding of 13 days however, will not be used as a habit since it disrupted her normal cycle.
Now concerning your case, because you started bleeding on the 26th of June and spotted until the 19th of July, you will apply the above ruling. The spotting exceeded the maximum period of ten days and so, you will view your previous valid cycle and determine the number of days of haydh from the 26th accordingly. If your habit was, for instance, eight days, then the 4th of July will mark the end of your haydh and the remaining bleeding until the 19th will be istihadha. Once you have determined the last day of your haydh, you will count a minimum period of 15 days before you can class any further bleeding as haydh.[3] So, the bleeding you saw on the 30th July, 31st July and 2nd August will all be classed as haydh, as there was most definitely a period of more than 15 days from your last cycle till the 30th July.

أما الاستحاضة فهي ما انتقص عن أقل الحيض، وما زاد على أكثر الحيض، والنفاس، ثم المستحاضة نوعان مبتدأة، وصاحبة عادة والمبتدأة نوعان مبتدأة بالحيض، ومبتدأة بالحبل، وصاحبة العادة نوعان صاحبة العادة في الحيض، وصاحبة العادة في النفاس. أما) المبتدأة بالحيض، وهي التي ابتدئت بالدم، واستمر بها فالعشرة من أول الشهر حيض؛ لأن هذا دم في أيام الحيض، وأمكن جعله حيضا فيجعل حيضا، وما زاد على العشرة يكون استحاضة، لأنه لا مزيد للحيض على العشرة، وهكذا في كل شهر. وأما) صاحبة العادة في الحيض إذا كانت عادتها عشرة فزاد الدم عليها فالزيادة استحاضة، وإن كانت عادتها خمسة فالزيادة عليها حيض معها إلى تمام العشرة لما ذكرنا في المبتدأة بالحيض، وإن جاوز العشرة فعادتها حيض، وما زاد عليها استحاضة لقول النبي – صلى الله عليه وسلم – «المستحاضة تدع الصلاة أيام أقرائها» أي: أيام حيضها، ولأن ما رأت في أيامها حيض بيقين، وما زاد على العشرة استحاضة بيقين، وما بين ذلك متردد بين أن يلحق بما قبله فيكون حيضا، فلا تصلي، وبين أن يلحق بما بعده فيكون استحاضة فتصلي، فلا تترك الصلاة بالشك
