Question: I have a significant prolapsed rectum due to which I only pass 50% of my waste which on a normal day makes me ill and I struggle with severe ibs which has multi causes such as unbearable stomach pain constipation back aches I struggle to fast and manage to keep half of my fasts each Ramadhฤn and struggle making up the rest My question is am I able to give fidya for my fasts or do I need to make them up ? As an Alimah I know I need to keep them up as this is the one of the reasons, Iโ€™ve been keeping them all these years but currently keeping them has made my condition worse Iโ€™m currently also waiting for surgery for my condition.ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย ย

Answer

In response to your inquiry, considering your present health condition, if fasting is exacerbating your health issues and causing substantial difficulty, it is permissible for you to abstain from fasting during Ramadhฤn.[1]

It is important to note that fidya is permissible for individuals who have a long-term or terminal illness with no reasonable hope of recovery, as compensation for missed fasts.[2]

Given that your situation involves a condition for which you are awaiting surgery, and your chance of recovery is not certain, you cannot consider paying fidya at this stage. Rather, the recommended course of action would be to postpone the fasts until you are sufficiently recovered to complete them later.[3]

If you paid fidya for missed fasts due to an expectation of no recovery, but recovery occurs after surgery, the fidya given will be treated as sadaqah (charity). You will still be required to perform qadha (make-up) fasts for the missed days.[4] On the other hand, if your condition remains the same or worsens after surgery and no hope of recovery, then you may continue paying fidya in place of fasting.

Answer

In reference to your query, itโ€™s not permissible for two or more individuals to share in the Qurbani of a small animal such as a goat or sheep. The Qurbani of a small animal is valid on behalf of a single person only.[1] Only large animals such as camels and cow can suffice up to maximum seven people.[2] A famous report from a companion in Sahih Muslim states;

 

โ€œWe participated in the sacrifice with the Messenger of Allah (saw) during the year of Hudaiybiyyah with a camel on behalf of seven people and a cow on behalf of seven peopleโ€.[3]

 

Those who permit more than one people sharing in a goat or sheep use the following narration. A companion reports, โ€œA man would sacrifice a sheep on of behalf of himself and members of his household during the time of Prophet (saw).โ€[4]

 

However, this Hadith means that a man would offer a single sheep to fulfil his own obligation, while simultaneously intending to include his household in the reward only. This narration does not imply that a single sheep fulfilled the obligation for multiple individuals. If more than one adult in the household is obligated to offer Qurbani, then each must offer a separate sacrifice, or arrange one to be made on his behalf.[5]

 

In conclusion, the Qurbani of a small animal (e.g., goat or sheep) is valid for one person only, while a large animal (cow or camel) can be shared by up to seven people.

When travelling to Makkah Mukarramah for สฟUmrah or Hajj, it is Sunnah to recite the following Duสฟฤ upon first sighting the Kaสฟbah. It is reported from Imฤm Makhul (Tabiสฟฤซ) rahimahullah that the Prophet sallallahu alayhi wasallam would recite the following Duสฟฤ when gazing at the Kaสฟbah.[1]

Trans: “O Allah, increase this House (the Kaสฟbah) in honour, nobility, and awe; and increase those who perform Hajj or สฟUmrah to it in honour, nobility, dignity, and righteousness.”

 

This Duสฟฤ is reported through multiple reliable chains, including in the Musnad of Imฤm Shafiสฟฤซ. The versions are mursal reports, where a Tabiสฟฤซ narrates from the prophet without mentioning a companion. Most Hadฤซth scholars accept mursal reports if supported by other reliable chains (shahid). Raising the hands during supplication when sighting the Kaสฟbah is debated due to differing Hadฤซth reports about the Prophetโ€™s sallallahu alayhi wasallam noble practice. Some say he did, others say he didn’t, leading scholars to disagree based on narratorโ€™s reliability and Hadฤซth authenticity. Details of the differing views are below, followed with our concluding analysis.

 

Permissibility of Raising the Hands

Imฤm Shafiสฟฤซ, Imฤm Ahmad, and some Hanafi jurists such as Ibn Humam, Mullah Ali Qari, and Karmani (may Allฤh have mercy on them all) consider it permissible. Shaykh Muhammad Hasan Shah, in his book “Ghyunyatun Nasik,” references these scholars in support of this view.[2] Mullah Ali Qari rahimahullah notes under the commentary of Hadฤซth No: 2574 the debate about whether Imฤm Abu Hanifah rahimahullah considered it Sunnah; some saying he did and others disagreeing.[3] Imฤm Shafiสฟฤซ rahimahullah allowed it but neither deemed it a Sunnah nor Mustahab due to conflicting reports. The evidence supporting their views are as follows:

 

Sayyiduna Abdullah Ibn Abbas radhiyallahu anhu reports, โ€œThe hands should not be raised except on seven occasions (namely); when one stands in prayer (the initial takbir), when seeing the house (Kaสฟbah), (ascending) Safa and Marwa, in Arafat (when supplicating), combining and the Jamarats (pelting the Shaytan).โ€[4] Ibn Juraij reports (with a missing link) that the Messenger of Allฤh sallallahu alayhi wasallam raised the hands whilst gazing at the Kaสฟbah and recited the Duสฟฤ (above). In another version reported by Ibn Juraij, with a connected chain to Sayyiduna Abdullah ibn Abbas radhiyallahu anhu, that the Messenger of Allฤh sallallahu alayhi wasallam raised his hands when looking at the Kaสฟbah and on seven other occasions, including during funeral prayers. Imฤm Shafiสฟฤซ rahimahullah in his Musnad and Imฤm Bayhaqi rahimahullah in both of his Sunan have recorded these narrations.[5]

 

Although Ibn Juraijโ€™s report is muสฟdhal (missing a link in the middle of the chain), it too has another connected chain. Additionally, Imฤm Makhul’s rahimahullah mursal narration supports Ibn Juraijโ€™s report, which states that the Prophet sallallahu alayhi wasallam recited the Duสฟฤ raising his hands when gazing at the Kaสฟbah. Ibn Battal rahimahullah in his commentary of Sahih Bukhari cites Makhul’s report in support of raising the hands.[6] ย In support of Ibn Juraijโ€™s narration with a missing link from Imฤm Shafiโ€™ฤซโ€™s Musnad, Mullah Ali Qari observes that โ€œBayhaqiโ€™s mursal report corroborates this account and a weak report lends support to the practice of raising the hands when facing the house.โ€[7]

 

Ibn Humam rahimahullah, a distinguished Hanafi jurist, prefers raising hands in supplication when first seeing the Kaสฟbah upon entering the Haram, as it is a time when all prayers are accepted. He also suggests asking Allฤh for admission into Jannah without reckoning. He further cites Imฤm สฟAta rahimahullah that the Prophet sallallahu alayhi wasallam would recite the following Duสฟฤ raising the hands when seeing the Kaสฟbah. [8]

Trans: “I seek refuge in the Lord of the House (the Kaสฟbah) from disbelief and poverty, from constriction of the chest (distress), and from the punishment of the grave.”

 

In summary, multiple reports with a weak chain due to a missing link collectively support each other and are acceptable for practice. Imฤm Khattabi rahimahullah notes that Hadฤซth scholars like Sufyan Thawri, Abdullah ibn Mubarak, Imฤm Ahmad ibn Hanbal, and Ishฤq ibn Rahwi (may Allฤh have mercy on them all) weakened the narrations against raising hands due to an anonymous narrator. Thus, they favoured the narration of Abdullah ibn Abbas radhiyallahu anha due to its support. Mullah Ali Qari rahimahullah prioritizes the reports affirming raising the hands over its disapproval because of the prevalent practice among scholars according to Baihaqi. Should the Hadฤซth against raising hands be accepted, it can apply to excessive raising of the hands. The affirming narration applies to the first sight of the Kaสฟbah, while the disapproving one negates raising hands on subsequent occasions.[9]

Disapproval of Raising the Hands

Imฤm Abu Hanifah, Imฤm Abu Yusuf, Imฤm Muhammad, [10] Imฤm Tahawi, and Ibn Abidฤซn Shamฤซ (may Allฤh have mercy on them all) all view raising the hands when sighting the Kaสฟbah as disliked. Their evidence is that a man once asked Sayyiduna Jabir radhiyallahu anha about raising his hands when seeing the Kaสฟbah. He responded, โ€œWe performed Hajj with the Prophet sallallahu alayhi wasallam and we never used to do it (i.e. raise the hands when gazing at the Kaสฟbah).โ€[11] According to the narration of Sunan Nasai, he resembled this to the practice of the Jews.[12]

 

Ibn Abidฤซn Shamฤซ radhiyallahu anha disallows raising the hands, noting its absence in key Hanafi texts. Imฤm Tahawฤซ rahimahullah mentions that Imฤms Abu Hanifah, Abu Yusuf, and Muhammad even disliked this practice.[13] Shaykh Zafar Ahmad Usmani Thanvi rahimahullah inclines towards its disapproval, stating that the narration of Jabir radhiyallahu anha occurred after Ibn Abbasโ€™ rahimahullah narration, implying that the permissibility was abrogated. The narration from Ibn Abbas radhiyallahu anha regarding raising the hands could also be interpreted as referring to the time of Istilam โ€“ greeting the black stone.[14]

Allamah Shawkani rahimahullah in his commentary of the above report, cites Imฤm Baihaqi, noting that Imฤm Shafiสฟฤซ was neutral on raising hands during supplication, indicating he did not rely fully on the disconnected chain of Ibn Juraij. Thus, the position is that raising hands lacks solid evidence as a sharสฟi ruling. However, general supplication without raising hands is supported by reports like Sayyiduna Umar radhiyallahu anha and others.[15] This however seems to contradict what Mullah Ali Qari rahimahullah noted earlier from Imฤm Baihaqi.

 

Shaykh Muhammad Mubarakpoori rahimahullah references Imฤm Khattabi rahimahullah, while scholars such as Sufyan Thawri, Abdullah ibn Mubarak, Imฤm Ahmad, and Ishฤq ibn Rahwi have considered Jabirโ€™s report to be weak due to the anonymity of the narrator Muhajir ibn Ikrimah al-Makki. Nevertheless, Ibn Hibban rahimahullah has authenticated this narrator, and Hafiz Ibn Hajr rahimahullah regards him as acceptable.[16]

 

In summary, according to this view, Sayyiduna Jabirโ€™s radhiyallahu anha report of disapproving raising hands is prioritised due to its strength.

 

Concluding Analysis

While there is no dispute about reciting prescribed Duสฟฤ or making general supplications in front of the Kaสฟbah, raising hands has been contentious. This illustrates differing views on Hadฤซth reliability and preferences, showing it is an Ijtihadic matter with room for scholarly differences. Those permitting raising hands view it as like other supplication practices, supported by weak narrations and corroborated by general practice. Opponents argue that affirmation reports remain weak due to inconsistent chains, with Shaykh Zafar Usmani Thanvi rahimahullah suggesting later reports negate earlier affirmations. The key difference is one group prioritizes affirmation with supporting evidence, while the other prioritizes negation until solid evidence is established.

 

Hanafi jurists are divided on this issue and both positions are valid. One may therefore follow either view. However, adopting the middle ground is preferred which is harmonizing both reports. As Mullah Ali Qari rahimahullah noted earlier, raising hands once applies only when sighting the Kaสฟbah for the first time, while negation reports imply not raising hands on subsequent sightings. In our humble opinion, this approach appears to be the most balanced and pragmatic, allowing us to implement both Hadฤซths within their proper contexts.

A Latecomer Joins the Eid Salฤh and Misses the Takbirs

Question: I understand that if a latecomer misses the takbirs of the Eid prayer in the first unit, he can say them in the bowing position. And if he misses the first unit, then when he stands up to make-up his missed unit after the Imฤm finishes the Salฤh, this latecomer recites the takbirs before going into ruku (I presume this is 3 takbirs, and that he raises his hands each time). My questions are as follows:

  1. If the latecomer catches the Imฤm in the bowing position of the second unit, would he also recite the 3 takbirs in the bowing position?
  2. If the latecomer misses 2 units by joining the Imฤm in sujud of the second rakat, then when are the takbirs performed when making up for them?

Answer:

Thank you for your question. In reference to your query,

 

  1. A person who joins the Eid Salฤh whilst the Imฤm is in the ruku position must first determine whether or not he will be able to perform the additional takbiraat (sing: takbir)by raising his hands to the ears thrice before joining the Imฤm in the ruku.[1] If he is certain that he is able to do this, then he will be required to perform them before proceeding into ruku. If unsure otherwise, then he must join the Imฤm in ruku and recite the 3 takbirs in ruku without raising his hands.

 

  1. A person who misses both rakats of the Eid Salฤh with the Imฤm will make up for the missed takbiraat in their original sequence.[2] Which is 3 takbirs before the qira`ah in the first rakat and the additional 3 after the qira`ah of the 2nd rakat (raising his hands each time). [3]This is because he is now completing his own Salฤh individually and therefore must make up for the missed takbiraat.

Entering Makkah without Ihrฤm and then Returning to Makkah for Umrah from Madinah

Question: A female was due to travel to Makkah to perform Umrah. She came on her period before her travel and before she made the intention to perform Umrah. She travelled from the UK to Makkah, stayed a day and then went to Madinah. She then wore her Ihrฤm and travelled from Madinah to Makkah to perform her Umrah. Does she need to pay any Dam or anything similar because she passed the Miqฤt point without being in an Ihrฤm state the first time? Please share some clarity on this.

Answer:

Thank for your query. It is generally not permissible to cross the Miqฤt (boundary) without being in the state of Ihrฤm. This requirement serves to uphold and preserve the sanctity of the sacred city of Makkah.[1] If anyone crosses the Miqฤt without the state of Ihrฤm for โ€˜Umrah or Hajj, then they have violated one of the important conditions of Ihrฤm and hence, become liable to offer a damโ€”a compensatory sacrifice of a sheep, goat or one-seventh share of a large animal. If they return to a Miqฤt and renewed their Ihrฤm from there then the initial dam becomes dropped.[2]

In case of the sister, her journey from Madinah to Makkah was a separate occasion and required a new and distinct Ihrฤm, which she correctly undertook. However, this subsequent act of donning the Ihrฤm does not absolve the original error of having crossed the Miqฤt without Ihrฤm. Therefore, the initial dam remains binding on her and is not waived. Her Umrah upon returning to Makkah from Madinah would suffice and she is not required to perform an additional Umrah. Nonetheless, she still needs to offer a dam as explained above.[3]

Question:ย  My friend is salaried class and earns 60,000 PKR per month which is lower middle class income in Pakistan. He owns a motorcycle worth of 120,000 and has no other asset, but he has bought a property out rightly for 3,000,000, but issue is that this money is stuck since couple of years and property hasn’t been given to him, but since past 6 months, this property is on rent of 15,000 and though it is still not transferred to his name due to fraud but now it’s making progress, so since 6 months rent of 15,000 is also being received. He has loan payable of 1,500,000. He supports his wife and 3 daughters aged (13, 6, 2 ) two are school going. He lives in rent free room at a normal locality. Would he be eligible for Zakฤt to help him pay off his loan? At the same time, I feel like he has an issue of taking loan as he states that he cannot spend his life on 60,000 + 15,000 per month and normally takes little loan every month which keeps on adding up.

Answer

In reference to your query, as a general rule Zakฤt is due on a person who possesses the nisab (minimum threshold of wealth) for a full lunar year.[1] The nisab is traditionally measured according to the silver value, which is 612.36g grams ย of silver. The market value of silver varies, but as a rough estimate, the nisab is usually between 5,500 PKR to 6,500 PKR, depending on the price of silver. Zakat is obligatory when oneโ€™s wealth exceeds this threshold after deducting any outstanding debts.[2]

In your friendโ€™s case, it states that he earns a monthly salary of 60,000 PKR and also received monthly rental income of 15,000 PKR for the past six months from a property he purchased for 3,000,000 PKR. However, the property has not yet been transferred on to his name due to an ongoing legal issue. Despite this, the rental income belongs to him. This rental income could potentially amount to 180,000 PKR by the end of the year and his salary to 720,000 PKR a year. This totals his annual earnings to 900,000 PKR. This obviously fluctuates every year depending on his outgoing expenses and how much he can save.

Nevertheless, it is clear that his debt exceeds his earnings. ย You also alluded that he is taking additional loan for supplementary financial support. He can therefore be eligible for Zakฤt to help him pay of his personal loan with the condition that he does not possess any surplus of wealth or assets beyond his essentials amounting to the nisab value, he is surviving on daily essentials, living on very little amount enough to feed his family after excluding his daily expenses and utilities, and not borrowing additional money frivolously.[3]

It must be noted that scholars differ regarding short-term and long-term debt. Irrespective of this, he qualifies as a Zakฤt recipient so long as he fulfils the aforementioned conditions.

Taking Epilepsy Medication Whilst Fasting

Question: Does taking Epilim (epilepsy medication) during fasting hours break the fast, considering that not taking it could lead to a seizure?

Answer

Eplilim is a brand that serves the medication โ€˜sodium valproateโ€™ to prevent seizures for epilepsy. A specialist doctor prescribes it, and it requires a second opinion from another specialist to show that there is no other suitable treatment. It comes as capsules, tablets and a liquid that you swallow. Sodium valproate can also be given by injection, but this is usually only done in hospital.[i]

If you have been prescribed this medication after consultation with specialist doctors and there is no other alternative, then suggest you adopt one of the following:

  1. First, you should see if you can take your medication during non-fasting hours to manage your condition, i.e. from the time of iftar to the time of sehrฤซ.
  2. If it is not possible because you fear the increase of your illness based on past experience and/or you have sought advice from an experienced Muslim doctor, then it will not be possible for you to fast at the same time as taking the medication.[ii] Taking medication will nullify the fast, regardless of whether it is nutritional or not.[iii] The only exception is if you were given this by injection.[iv] If you must take the medication during fasting hours, it is advised to receive this via injection so that you are able to fast in Ramadhฤn.
  3. In the instance where you had to take the medication orally during fasting hours, then you must make up for the missed fasts later. Kaffarah will not be necessary.
  4. If your condition is so severe that you will not be able to make up the fast at any other time of the year and are not expected to gain the ability to make up the fasts till your death, then you may give fidyah (expiatory payment). If one became well enough to fast, then the fidyah one has given will be classed as voluntary and it will be necessary to make up the fast. Fidyah is the same amount as sadaqatul fitr.[v]

Calculating Zakฤt on Gold Jewellery

Question: How is Zakฤt calculated on gold jewellery. Most jewelleries are mixed with other substances and not pure gold. For instance, 8, 9 and 10 carat gold are not pure gold so how do we calculate Zakฤt on them?

Answer

There are generally two views on calculating Zakฤt on gold mixed with other substances such as metal or copper. One view, which is the most popular view, is that Zakฤt is obligatory on those gold assets that comprise of majority gold. If the proportion of gold is less compared to other substances, then Zakฤt is not obligatory. So Zakฤt will not be necessary on 6,8,9 or 10 carat gold (or even 12 carat since it is half) as they contain less gold substance. Gold between 14-24 carat gold will be Zakฤtable if collectively reaches the required threshold, 87.48g. The reason is the minor gold content is overpowered by other substances and therefore does not take the ruling of pure gold, unlike 14 carat gold and beyond where the majority being gold takes the ruling of pure gold. This is in congruent with the classical understanding of the Hanafi jurisprudence.[1]

The second view which is the precautious view is that irrespective of the proportion of gold composition whether majority or minority, Zakฤt will be calculated on the gold content alone. Shaykh Mufti Radhaul Haq maintains that Zakฤt must be calculated as a precaution.[2]ย  This is so that the more Zakฤt is dispensed, the greater benefit it serves for the poor. This ruling applies only if the small percentage of gold content can be separated from other metals by melting. If it cannot be separated, then Zakฤt will not be calculated according to everyone.

Considering the second view, the monetary value of the small percentage of gold will be estimated and then 2.5% of the value will be calculated for Zakฤt. To give two examples for illustration. Suppose if someone has 8 carat gold which comprises of 33.3% of gold. This means that 66.7% is metal. This gold weighs 10g and the estimated value of 1g of gold is ยฃ50. So from 10g, only 3.33g is pure gold (33.3% x 10g) andย  then, multiplying ยฃ50 with 3.33g gives you the monetary value of ยฃ166.50. Now calculating 2.5% of ยฃ166.50 gives you the total net Zakฤt of ยฃ4.16.

Another example, someone possesses 10 carat gold weighing 20g, each gram worth ยฃ50. 10 carat comprises of 41.7% of gold only. 41.7% of 20g means that only 8.34g is pure gold. This gives you the monetary value of ยฃ417.00 (ยฃ50 x 8.34). 2.5% of ยฃ417.00 gives you the total Zakฤt of ยฃ10.43.

Most jewellers use this method to calculate Zakฤt on gold and is the precautious view as mentioned, otherwise the classical Hanafi understanding is the first view which is determining Zakฤt by the majority content.

Answer

โ€œHormone replacement therapy (HRT) is a treatment used to help menopause symptoms. It replaces the hormones oestrogen and progesterone, which fall to low levels as you approach the menopause… Oestrogen and progesterone are an essential part of period cycles, ovulation and pregnancy. They also keep your bones healthy. As you get older, the loss of these hormones can have a big effect on your body.โ€ (NHS)[i]

HRT patches or gels are applied to the skin and release oestrogen and/or progesterone in a small amount continuously. For anything to break the fast, it must reach the stomach, throat or the intestines through a qualified passage such as the mouth, nose and back passage. The arm is not classed as a qualified passage because it does not give direct access to a personโ€™s stomach and brain. Hence, if a person applies HRT patches or gels on their arm while fasting, their fast will not break.[ii]

Answer

It is necessary to first understand how a credit card works. A credit card lets you borrow money from your card provider to make purchases.ย You can use your card to spend as you need but will have to pay back the card provider within a period of time before a percentage of interest is added to the fee. Essentially, the money on your credit card is not in yours as it is a form of a loan from the bank. Once a person uses the money on their credit card, they will then be in debt to repay the bank. For this reason, the money on your credit card once used, will not be included as part of ones โ€œZakฤt-ableโ€ assets, as it is a debt due on a person to be returned to the bank. One condition of what makes your wealth eligible for Zakฤt, is to be free of debt. If a person has an outstanding debt, he will deduct this from his wealth and pay Zakฤt on what remains.[1] It must be noted that the interest debt that one incurs for delayed payment for instance is not deductible from Zakฤt and must be included in the Zakฤt calculation.
