Question: I need some clarification regarding my son. He was Islamically married to a Christian woman from a Catholic background. No civil marriage happened. Now they are separated. He would like to divorce her. They don’t see each other. How can he do that please? Via text/WhatsApp, etc. Could you please advise whether his Nikah was valid in the first place and the exact wording/text he must use for divorce? If he divorces her, is she required to observe an Iddah?

Answer
In reference to your query, the nikah between your son and his Christian wife (despite no civil marriage) was valid, provided she strictly followed the religious teachings of her faith. This is because in Islam it is allowed for a man to marry a woman from amongst the ahlul kitab, in the hope that such marriage would lead her to voluntarily accepting Islām. The ahl kitab are those who believe and strictly follow the divine scripture and do not engage in promiscuity or any unlawful acts.[1] This includes any Christian woman who follows and adheres to the strict Catholic teaching. Despite this, in today’s day and age it would be disliked marrying them given the possibility of them negatively impacting future children with kufr beliefs.[2]
As for initiating the divorce, if the husband is sound minded then he may text/WhatsApp her the divorce using the same wordings as he would if he were to do so verbally.[3] For instance, texting her ‘you are divorced’, or ‘I divorce you’. The divorce will take immediate effect and would result in one divorce.[4] Following the divorce, she will observe the prescribed Iddah because she married a Muslim man and the Quranic injunctions pertaining to Iddah makes no distinction between a Muslim or an ahl kitab wife.[5]
