Question: A woman has been given two divorces. The second time round the husband has been really persistent to get back but her iddah period finished so they would need to do a new nikah. The question is if she agrees to remarry him, can she put a clause in her nikah that if he divorces her again, he will pay her an X amount of money. This is as a safety net for her, to act as a deterrent for him, and to give her that peace of mind that he is definitely serious this time and will not leave her when things get tough. Is this clause valid? Please provide an explanation.

In the name of Allāh, the Most Gracious, the Most Merciful
Answer: If the woman’s second iddah has ended, she can remarry her former husband through a new Nikah, provided the necessary conditions of Nikah are fulfilled.
Regarding the proposed condition, if the husband agrees at the time of the Nikah that in the event of a subsequent divorce he will pay his wife a specified amount, then such a condition is permissible so to protect the marriage from irrevocably breaking, provided the amount is clearly specified and the husband willingly agrees to it.[1] A condition of this nature is treated as an undertaking which the husband is required to fulfil if the stipulated circumstance occurs. Therefore, if he subsequently divorces her in the manner specified in the agreement, he will be required to fulfil the financial condition, and thus will be permissible for her to take.[2]

كأن تزوجها بألف على أن يخرجها من البلد، أو على أن يكرمها أو يهدي لها هدية، أو على أن يزوج أباها ابنته، أو على أن يعتق أخاها،أو على أن يطلق ضرتها
فإذا وفي فلها المسمى لأنه صلح مهرا وقد تم رضاها به، وعند فواته ينعدم رضاها بالمسمي فيكمل مهر مثلها

(إذا تزوجها على ألف على أن لا يخرجها من البلدة أو على أن لا يتزوج عليها أخرى، فإن وفى بالشرط فلها المسمى) لأنه صلح مهرا وقد تم رضاها به (وإن تزوج أخرى أو أخرجها فلها مهر مثلها) : لأنه سمى ما لها فيه نفع، فعند فواته ينعدم رضاها بالأف فيكمل مهر مثلها كما في تسمية الكرامة والهداية مع الأف (ولو تزوجها على ألف إن أقام بها و على ألفين إن أخرجها، فإن أقام بها فلها الألف، وإن أخرجها فلها مهر مثل لا يزاد على الألفين ولا ينقص عن الأف، وهذا عند أبي حنيفة، وقالا: الشرطان جميعا جائزان)…

قال (وإذا تزوجها على ألف على أن لا يخرجها من البلدة) قد تقدم أن النكاح لا يبطل بالشروط الفاسدة فإذا تزوج امرأة على ألف على أن لا يخرجها من البلدة (أو على ان يتزوج عليها) أو على يطلق فلانة فالنكاح صحيح وإن كان شرط عدم التزوج وعدم السفر و طلاق الضرة فاسد لأن فيه المنع عن الأمر المشروع (فإن وفى بالشرط فلها المسمى)
